Time Limit for Filing Appeal is Tolled by Rule 60 Motion

Mass. Rule of Appellate Procedure 4(a) and District/Municipal Courts Rule for Appellate Division Appeal 4(a) are amended to toll the time period for filing an appeal while a motion for relief from judgment under Rule 60 is being decided, if the motion was served within 10 days after entry of judgment, effective May 1, 2013. As a result, new Reporter’s Notes have been added to Mass. R. A. P. 4 and to Mass. R. Civ. P. 59 and 60.
