‘Access to justice’ on bar exam

The Access to Justice Commission last fall proposed that the subject of  'Access to Justice' be added to the topics tested on the state bar exam. The SJC is now seeking comments on the proposed topic. Comments must be in by March 24th.

Both positive and negative arguments have been published. The official memorandum can be found here. The Access to Justice Commission states that "the new topic would include substantive areas of law in which there is a high incidence of unmet legal needs; ethical issues that arise when not all litigants are fully represented; and due process doctrines related to fair hearings."
