Consumers Given Greater Protection by the Division of Insurance

In late 2013, the Massachusetts Division of Insurance issued regulations (211 CMR 135) that prohibit insurance companies and third party administrators from requiring a person to use a particular registered motor vehicle glass repair shop.  The regulations also state "An insured may at any point in time elect to change his or her choice of registered motor vehicle glass repair shop..."  If there is a violation of these regulations or Mass. General Laws chapter 175 sec. 113X, it constitutes an unfair or deceptive act under Mass. General Laws chapter 176D.  The penalties include a minimum fine of $1,000 per violation, and the Commissioner of Insurance must report the facts to the Attorney General or local District Attorney.  See also our webpage on consumer protection law.
